Definitions

– Conditions refers to these terms and conditions for all website sale of tyres and tyre installation services be it through mobile fitment or via our extensive network of partner fitment centers around the country.

– Customer refers to the natural person or company or entity that chooses under their free will to purchase tyres or any service being sold on raztyres.com.

– Customer’s Order refers to the order that a customer places to raztyres.com through the raztyres.com website by completing the ordering process set out therein through submission of forms and following a series of hypertext links as directed on the raztyres.com website.

– Sale refers to the services rendered by raztyres.com for the sale of tyres and other goods and services to our valued customers through the raztyres.com website and the subsequent
– Contract refers to the contract for the purchase and sale of the Goods as established and demonstrated by the customer’s order and the order confirmation. This will also give us the authority to arrange the installation of such tyres to customers’ vehicles using third party service providers.
– Goods / products refers to tyres (including any installation of the tyres or any parts for them) or services which raztyres.com is to supply in accordance with these terms and conditions.
– Order Confirmation refers to the confirmation in writing by raztyres.com of a customer’s order issued before the supply of the goods and / or services the customer would have purchased to him / herself.
-Writing refers and consists of electronic mail, telex, cable, facsimile transmission and comparable means of communication.
-Force Majeure means any Act of God, explosion, flood, tempest, lightning strike, fire, accident, war or threat of war, sabotage, insurrection, civil disturbance or requisition, acts, restrictions, regulations, bye laws, prohibitions or measures of any kind on the part of any governmental, parliamentary or local authority, import or export regulations or embargoes, strikes, lock outs or other industrial actions or trade disputes (whether involving employees of Razaro International FZ LLC or of a third-party), difficulties in obtaining raw materials, labour, fuel, parts or machinery or power failure or breakdown in machinery.

Conditions of Sales
raztyres.com shall sell tyres together with other goods and services and the customer shall purchase the goods in accordance with the customer’s order and order confirmation, subject to these conditions which shall govern the contract to the exclusion of any other terms and conditions subject to which any such offer is made or purported to be made by the customer. The Customer also acknowledges that the website text, our price lists, lists of items for sale or other sales literature published on the raztyres.com website constitute an invitation to treat and may not be construed by the Customer as any offer by or binding obligation upon raztyres.com to sell any item to the Customer. Under no circumstances can changes to these Terms & Conditions be made unless agreed upon in writing between authorized representatives of the Customer and raztyres.com. raztyres.com’s employees or agents are not permitted to make any representations concerning the goods unless confirmed in writing by raztyres.com. In entering into this contract, the customer acknowledges that it does not rely on any such representations which are not so confirmed in writing by raztyres.com. If any advice or recommendation is given by raztyres.com or its employees or agents to the customer or its employees or agents as to the safe keeping, application or use of the goods or tyres which won’t be confirmed in writing by us (raztyres.com) is followed or acted upon entirely at the customer’s own risk, and accordingly raztyres.com shall not be liable for any such advice or recommendation which is not so confirmed in writing. Whilst every effort is made by raztyres.com to ensure no such error or omission occurs, any typographical, clerical or other error or omission in any sales literature, price list, website text, acceptance of offer, invoice or other document or information issued by raztyres.com shall be subject to correction without any liability on the part of raztyres.com.

Offer Conditions
Orders placed by the customer shall not be considered as completely processed by raztyres.com until the confirmation order has been received from the Customer. It is the customer’s responsibility to raztyres.com for ensuring the accuracy of the terms of the customer’s order submitted by the him / her, and for passing on any necessary information to raztyres.com relating to the goods or services purchased within a sufficient time to enable raztyres.com to perform the contract in accordance with its terms. We (raztyres.com) shall incur no liability resulting from inaccurate information being supplied by the customer. The quality and quantity of the product or goods will be as per the standard details provided in the confirmation order. raztyres.com reserves the right to alter the goods, any relative specifications or prices (whether such specifications have been submitted by the customer in the customer’s order or otherwise) and designs at any given time, without notice as a result of changes in the law or at the sole discretion of raztyres.com. The order placed by a customer may not be cancelled by the customer after the confirmation order has been issued unless there is a written agreement by raztyres.com and under the terms that the customer shall indemnify raztyres.com in full against any loss (including loss of profit), costs (including the cost of all labor and materials used), damages, charges and expenses incurred by raztyres.com as a result of cancellation by the customer of the customer’s order.

Pricing of Goods and Services
The price of products and services listed on the website raztyres.com and order confirmation will be decided by Razaro International FZ LLC. If there is no price quoted in the order confirmation then the price list defined on the website raztyres.com at the date & time of order confirmation will be considered as per the terms. raztyres.com reserves the right, at any time, to increase or decrease the price of the products and services to reflect any increase or decrease in the cost to us (raztyres.com) which is due to any factor beyond the control of raztyres.com (such as and without limitation: any foreign exchange fluctuation, currency regulation, alteration of duties, significant increase in the costs of labor, materials, inaccurate data or other costs of manufacture), any change in delivery dates, quantities or specifications for the products and services which would have been requested by the Customer, or any delay caused by any instructions of the customer or failure of the customer to give raztyres.com adequate information or instructions. The UAE government has introduced VAT from 1 January 2018. VAT is chargeable on the supply of most goods and services in the UAE at a standard rate of 5%. All products and services priced on raztyres.com include VAT in all cases where VAT is applicable.

Payment Terms
With reference to any written communication between raztyres.com and the customer, raztyres.com will be entitled for full payment for the products and services on the same day when the confirmation order is received. raztyres.com will have the right to debit the credit / debit card of the customer for the full payment against the products or services on the same day of order confirmation or after that date. The customer will be obliged to pay the price of the goods or services on the date the customer places the order. raztyres.com shall be entitled to recover the price of the products and services, notwithstanding that delivery may not have taken place and the property of the products has not passed to the customer. The time of payment of the price shall be of the essence of the contract. Receipts for payment will be issued electronically. A printed version can be provided for upon request. If for any reason the customer fails to make any payment by the relevant due date or if payment is declined or not authorized by the issuer of the customer’s credit / debit card when processed by raztyres.com then, without prejudice to any other right or remedy available to raztyres.com, raztyres.com shall be entitled to cancel the Contract or suspend any further deliveries to the customer, appropriate any payment made by the customer to such of the goods (or the goods supplied under any other contract between the customer and raztyres.com) as raztyres.com may think fit (notwithstanding any purported appropriation by the customer); and charge the customer fees (both before and after any decree or judgement) on any amount unpaid, at the rate of 2% per month on the amounts unpaid, until payment in full is made (a part of a month being treated as a full month for the purpose of calculating the fee).

Delivery of goods and services
When raztyres.com receives the confirmation order from the customer, raztyres.com will deliver the products and or cater the installation or fitment services at the customer address mentioned in the Order Confirmation or any other address as suggested by the customer and approved by raztyres.com. Regarding the dates quoted for delivery and/or installation of the products, these are approximate only and not guaranteed therefore raztyres.com shall not be liable or responsible for any delay in delivery and/or installation or fitment of the products howsoever caused. Time for delivery or installation shall not be of the essence of the contract unless previously agreed by raztyres.com in writing. If the customer does not claim the products and services or if the information provided by the customer is incorrect or inadequate to deliver the product or services, then raztyres.com will have no option and without any biasness or prejudice, we (raztyres.com) will keep the goods until actual delivery and charge the customer for the reasonable costs (including insurance) of storage. We may also sell the goods at the best price readily obtainable and (after deducting all reasonable storage and selling expenses) account to the customer for the excess over the price under the contract or charge the customer for any shortfall below the price under the contract. We may also return to the manufacturer or supplier and the cost for the return shall be added to the customer account. Delivery of the goods shall be evidenced by the return to raztyres.com of its or its authorized carriers’ official packing/delivery note which, howsoever signed as acknowledgement of receipt of the goods, shall constitute absolute proof of delivery of the items specified in it.

Property & Risk
Risk of damage to or loss of the goods shall pass to the customer where the sale (subject to the terms and conditions of the relevant tyre installation agreement between raztyres.com and the relevant installation center to the contrary which, if any such agreement exists, shall take precedence) at the time when the customer is notified that the goods have been fitted and are ready for collection. Any risk of passing the products or delivery or any other provision related to these conditions, the title of the product shall not be passed to the customer until the full payment (including all kinds of fees and charges) of the products is made by the customer to raztyres.com. The customer shall not be entitled in any way to charge by way of security for any indebtedness any of the goods which remain the property of raztyres.com, but if the customer does so, all moneys owing by the customer to raztyres.com shall (without prejudice to any other right or remedy of raztyres.com) forthwith become due and payable.

Return conditions
The customer has the right to cancel the contract and return the goods and receive a refund (or where the goods have not been paid for, full credit), provided that the goods remain unused, are in the same good condition in which they were received by the customer and are returned to raztyres.com. In this event, the customer will be responsible for all the costs of returning the goods and shall indemnify raztyres.com or demand against all and any such costs. If raztyres.com accepts the goods, raztyres.com retains the right to charge the customer for any direct costs associated with the return of the goods. No additional restocking charge or administrational charge will be levied to the customer. Our customer care department can be contacted for an accurate cost on returning goods as costs may vary depending on tyre specification and location. All goods and services including tyres purchased under special promotion, rare sizes, specialized tyres or race/ track tyres cannot be returned or refunded. Refunds to the customer are entirely at the discretion of raztyres.com and in the event that raztyres.com, in their sole discretion, grant a refund to a customer, all of the costs incurred by raztyres.com in procuring that refund shall be for the customer’s account in full.

Liability conditions

raztyres.com will have no liability for any defective goods due to the inaccuracy in the customer Order form. raztyres.com will have no liability on the loss of product or incorrect information in Customer order. raztyres.com will also be under no liability in respect of any defect in the goods arising from fair wear and tear, intent damage, negligence, abnormal working conditions & failure to follow raztyres.com’s instructions (whether verbal or in writing) or misuse or alteration / change in any way whatsoever or the repair of the goods or products including tyres without raztyres.com’s written consent. As expressed in these terms and conditions, warranties, or other terms and conditions that is implied by the statute or common law will be excluded for the maximum extent. If the customer has any claim of any kind relating to any defect in the quality or condition of the goods or their failure to correspond with specification shall be notified to raztyres.com in writing within 24 hours from the date of delivery or installation or where the defect or failure was not apparent on reasonable inspection, within 24 hours after discovery of the defect or failure. Failure of the customer to notify raztyres.com regarding the previous point, the customer will not be able to reject the goods and raztyres.com shall have no liability for such defect or failure. If the customer claim is related to product defects, quality of product or improper installation services to reported and found to genuine, then in this specific case raztyres.com will be liable to replace the product or arrange for another service free of charge to the customer or refund as per the conditions or charge for specific proportion of services, fees, or charges as per the refund policy. raztyres.com shall have the sole discretion to charge or refund for the product return and have no liability against the customer or any other person. raztyres.com shall not be liable to the customer by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, or under the express terms of the contract, for any indirect, special or consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for compensation whatsoever (whether caused by the negligence of raztyres.com, its employees or agents or otherwise) which arise out of or in connection with the supply or installation of the goods or their use or resale by the customer, and the entire liability of raztyres.com under or in connection with the contract shall not exceed the price of the goods, except as expressly provided in these conditions. If the goods or services ordered at not available or undeliverable for any reason, raztyres.com reserves the right to cancel the order and issue the customer a full refund without assigning any reason or justification. raztyres.com shall also not be liable to the customer or be deemed to be in breach of the contract by reason of any delay in performing, or any failure to perform, any of raztyres.com’s obligations in relation to the goods, if the delay or failure was due to any Force Majeure or other cause beyond raztyres.com’s reasonable control.

General terms & conditions
raztyres.com may perform any of its obligations or exercise any of its rights hereunder by itself or where applicable through any other persons (legal or otherwise) or entities. Any notice required or permitted to be given by either party to the other under these terms & conditions shall be in writing addressed to that other party at its registered office or principal place of business or such other address as may at the relevant time have been notified pursuant to this provision to the party giving the notice. No waiver by raztyres.com of any breach of the contract by the customer shall be considered as a waiver of any subsequent breach of the same or any other provision. If any provision of these conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these terms & conditions and the remainder of the provision in question shall not be affected. The contract and these terms & conditions shall constitute the entire agreement between the customer and raztyres.com in respect of the supply of the goods and shall supersede all previous verbal or written representations or agreements relating thereto. In particular, the customer may not rely on any statements made by any employee, representative or agent of raztyres.com. raztyres.com may assign the contract with the customer or sub-contract the whole, or any part thereof to any other person (legal or otherwise) or entity. Unless otherwise agreed in writing, the customer may not assign either the benefit or the burden of any contract with raztyres.com. The contract shall be governed by the law of the United Arab Emirates and the customer agrees to submit to the non exclusive jurisdiction of the UAE courts. The customer using the website who are Minor /under the age of 18 shall not register as a User of the website and shall not transact on or use the website. We accept payments online using Visa and MasterCard credit / debit card in AED. The cardholder must retain a copy of transaction records and Merchant policies and rules. raztyres.com will NOT deal or provide any services or products to any of OFAC (Office of Foreign Assets Control) sanctioned countries in accordance with the law of UAE. raztyres.com does not make deliveries of tyres to a customers home address. Tyres will only be delivered to the chosen Installer, whether a physical location or mobile. The customer will be notified for fulfillment only after tyres have been received by the installer. Hence, we do not have a stated delivery policy.
